Corporate Manslaughter Puts Director in Legal Trouble

In the first case that has come for trial under the Corporate Manslaughter Act of 2007, Peter Eaton and his company Cotswold Geotechnical Holdings Ltd were jointly charged with negligence leading to manslaughter.

Crown Prosecution Service brought up the case against the director when Alexander Wright, a geologist with the company died while collecting soil samples inside a trench. The incident took place in September 2008.

Since then Peter Eaton has been to court once where in the short proceeding, he just confirmed his name. The judge allowed him bail until the next hearing where he will be allowed to respond against the charges. The prosecution charged him with failing to obey Section 37 of the Health and Safety at Work etc. Act 1974 (’HSWA’) and also for gross negligence manslaughter under the Corporate Manslaughter Act of 2007. He is scheduled to appear in court on 19 August.

According to the HWSA, Eaton was responsible as the Act clearly defines that if it is proved that the transgression was as a result of the recklessness caused by the consent of the a senior office of the company, then he will be prosecuted. The course is aimed at Directors, Vice Presidents, Senior Executives and other senior managers who have the responsibility for policy making and strategic planning for health and safety within the organisation. What have I been reading of late, What I believe around twitter and why blogging is the best.

I have been taking in a lot of great new blogs of late. I am still waiting to decide about all the twitter tizzy. I still enjoy blogs and have over 1000 in my feed reader.

The cool thing about blogs is that you can find hidden treasures, and they are from individuals that actually like to can write.

Sure you can chance some groovy individuals on twitter. But, seriously, twitter is for people with add or who dont like to write normal posts. Yes, heaps of people twitter and also blog, and those people are stylish by me, but I am perpetually and perpetually a blog devotee.

Blogs force the author to actually articluate their opinion. Twitter on the other hand merely permits you to state it. Call me old fashioned but I believe there is a point where smaller is no longer easier. We have been obsessed with miniturization for so long. Specially when it comes to technology. Surely there has to be a point where we take in substance matters. Value matters. What do you suppose?

Maybe the actual answer dwells in balance. And compromise. You cannot squeeze people to have substance and not be shallow. But, too possibly you need to drive the neo libral hippies to lighten up a fraction too?

On May 1, 2009, there was a recall of 14 Hydroxycut diet-aid products coming from a number of reports that people using the products were developing serious liver issues and other health worries. Less than seven days later, on May 4, the first Hydroxycut class action lawsuit was filed against the company that manufactures the products, Iovate Medical Sciences. The Hydroxycut Case alleges company failure in informing the public about potential hazards of the products. Naturally, it’s too soon to understand the suit is going to turn out, but if the company had information which it didn’t divulge to buyers, it should definitely be held accountable.

A class action legal action is filed by a bunch of folks, all of whom have similar claims against a certain company. Filing a class action is just as effective, and far less dear, than filing an individual suit. As a rule, filing a class action lawsuit won’t cost anything unless there’s a settlement. At that time, the lawyer who handled the suit will take his charges from the compensation that got given and then assign the leftover funds to the accusers in the case. The initial class action legal action against Iovate was filed in Canada where the company is located and represents all Canadian voters who sustained health issues due to Hydroxycut products. The FDA recall occurred in the US where 23 cases of liver disorders and other health problems had been reported. Health Canada did not receive any reports of liver damage due to the diet products, but they did receive 17 reports concerning folks who sustained respiration, neurological, heart, and stomach problems as a result of Canadians using the products.

The Hydroxycut Lawsuit alleges that the products without correctly informing the general public of the public of the health risks that they could exposing consumers to. The complaint states that the company failed to publish the data on the product labels saying that users could run the chance of liver and kidney damage as well as stomach, heart, respiration, and neurological issues. The suit goes on to claim this was a blatant omission on the part of the company which deliberately misled clients concerning the safety of the products.

Had this report appeared six months ago, it would have provided some very sober reading for wine investors. Not least because the end of 2008 coincided with the first significant correction in the fine wine market for more than a decade. Now investing in wine looks like it might pay dividends

During the first half of 2008, Liv-ex, an index of the top 100 investable wines, climbed by a steady and impressive 9.5 per cent before stalling during the summer. In the final quarter of 2008 it fell by nearly 25 per cent; in October it lost more than 12 per cent of its value - the biggest monthly movement since its inception in 2001.

There are no prizes for guessing why. Despite the fact that the fine wine market had seemed impressively impervious to the hurricane blowing through the financial markets for most of last year, it clearly could not remain immune indefinitely. The collapse of Lehman Brothers was the turning point, as many private and institutional investors desperately sought to avoid losses in the ensuing dash for cash.

They were not the only ones looking to liquidate their wine holdings: merchants had seen the writing on the wall and had already begun to empty their inventories. Distressed sellers and restaurants also started offloading, while a number of wine funds found themselves on the receiving end of growing numbers of redemptions.

Never before had such a flood of investment-grade wine appeared on the market simultaneously. At one stage, it seemed to almost grind to a halt as prices tumbled.

The wines that lost the most value were, of course, those clarets that had gained the most in the bull run of the previous two years. Initially, that meant the top 2005s, which had surged in price and were in plentiful supply. Some prices fell by up to 50 per cent.

However, as things got worse, it was not just the 2005s that started to feel the pressure. Older vintages such as the 2003s and 2000s were also sucked in, as forced sellers continued to dump stock.

The contagion also spread to rarer and more mature vintages, pulling down prices of 1996s and the 1990s in their wake.
